1. Acceptance of Terms

By accessing and using ColorBliss ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. These Terms of Service ("Terms") govern your use of our AI-powered coloring sheet generation platform.

2. Description of Service

ColorBliss is an AI-powered platform that generates custom coloring sheets and pages based on your prompts, photos, and other inputs. Outputs are AI-generated. Your rights to use those outputs are set out in the Content and intellectual property section below, including any limits that apply to your plan.

3. User Accounts and Registration

To access certain features of the Service, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your account information
• All activities that occur under your account
• Providing accurate and complete information during registration
• Promptly updating your account information as needed

4. Acceptable Use Policy

You agree to use ColorBliss only for lawful purposes and in accordance with these Terms. You may not:

• Generate content that is illegal, harmful, threatening, abusive, or offensive
• Create content that infringes on intellectual property rights
• Sell, sublicense, or commercially distribute generated content if your subscription does not include a commercial license
• Attempt to reverse engineer, hack, or disrupt the service
• Generate excessive requests that could harm service performance
• Share account credentials with others

5. Content and Intellectual Property

5.1 User-Generated Content

You retain ownership of the prompts and descriptions you provide to generate coloring sheets. However, by using our service, you grant ColorBliss a non-exclusive license to process your content for the purpose of generating your requested coloring sheets.

5.2 License to generated content

If your plan does not include commercial use, ColorBliss grants you a personal, non-exclusive license to use generated coloring pages and related output for personal, educational, and other non-commercial purposes only. You may not sell, sublicense, or commercially distribute that content.

If your plan includes commercial use, ColorBliss grants you a perpetual, worldwide, non-exclusive license to use, reproduce, modify, distribute, publicly display, and create derivative works from coloring pages and related output that the Service generates for your account. You may incorporate them in commercial products such as books, printables, and other digital or physical goods, and sell those products to end customers. Commercial plans are described in our pricing or checkout at the time you subscribe (for example Artist or Business tiers when those labels apply).

The commercial license explicitly includes use on print-on-demand and self-publishing platforms such as Amazon Kindle Direct Publishing (KDP), including resale inside publications you create (for example coloring books).

Because outputs are produced using artificial intelligence, they may not qualify for copyright protection in some jurisdictions under current law (for example in the United States, works without sufficient human authorship may not be copyrightable). ColorBliss does not represent that you will own copyright in generated output, and these Terms do not transfer copyright ownership to you. Instead, we grant the usage rights described in this section for your plan.

For plans that include commercial use, you do not owe ColorBliss royalties, attribution, or additional fees for that authorized commercial use of generated content, beyond the fees for your subscription or other stated charges.

5.3 ColorBliss Intellectual Property

The ColorBliss platform, including our AI models, algorithms, website design, and branding, are protected by intellectual property laws and remain the exclusive property of ColorBliss.

6. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

7. Payment and Billing

Some features of ColorBliss may require payment. By subscribing to paid features, you agree to:

• Pay all fees associated with your selected plan
• Provide accurate billing information
• Authorize automatic recurring payments for subscription plans
• Understand that fees are non-refundable except as required by law

8. Service Availability and Modifications

We strive to maintain high service availability but cannot guarantee uninterrupted access. We reserve the right to:

• Modify or discontinue the service with reasonable notice
• Perform maintenance that may temporarily affect service availability
• Update these Terms of Service as needed
• Change pricing with 30 days notice for existing subscribers

9. Disclaimers and Limitation of Liability

9.1 Service Disclaimer

ColorBliss is provided "as is" without warranties of any kind. We do not guarantee that the service will meet your specific requirements or that generated content will always meet your expectations.

9.2 Limitation of Liability

To the maximum extent permitted by law, ColorBliss shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

10. Account Termination

We may suspend or terminate your account if you violate these Terms. You may also terminate your account at any time by contacting our support team. Upon termination:

• Your access to the service will be discontinued
• You remain responsible for any outstanding fees
• We may delete your account data after a reasonable period

11. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of ColorBliss will be resolved through binding arbitration, except where prohibited by law.

12. Changes to Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this page and update the "Last updated" date. Continued use of the service after changes constitutes acceptance of the new Terms.
